TERMS

1. GENERAL

1.1 The use of the "E77" website ("our Site") and all services provided are subject to the following terms and conditions and any other terms posted from time to time on our Site ("our T&C").

1.2 We reserve the right to vary our T&C at any time and any changes take effect as soon as posted on our Site.

1.3 If you wish to use our services, you must read and agree to be bound by our T&C. By visiting our Site you are accepting and consent to the provisions set out in our T&C.

1.4 Please do read our T&C carefully. If you cannot agree to any of our T&C you must immediately stop using our Site.

2. REGISTRATION

To use the services or features made available to you on our Site, you will need to register. When you register, you are required to provide information about yourself that is current, accurate and complete in all respects. Should any of your registration information change, you must notify us immediately at the following email address. We may change registration requirements from time to time.

3. PURCHASING

3.1 The purchase of any products through E77 is restricted to persons who can lawfully enter into and form contracts on our Site in accordance with English Law.

3.2 To purchase through our Site, you must register and provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other information as indicated. When you order from us you will be required to provide payment details and you confirm that those payment details are correct and that you are the person referred to in the billing information provided.

3.3 Our Site is only available to persons who meet our terms of eligibility, who have been issued with a valid debit or credit card by a bank acceptable to us and who have authorised us to process a charge or charges on their card for the total purchase price of the items which they are purchasing.

3.4 Purchases made on our Site are for the personal use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit.

3.5 By making an offer to purchase from us, you authorise us to perform credit checks and, where necessary, transmit or obtain information about you, to or from third parties from time to time, including but not limited to your card numbers or credit reports to authenticate your identity and to authorise individual purchase transactions.

4. ORDERS

4.1 All orders are subject to acceptance and availability. Prices quoted on our Site are in GBP and are inclusive of VAT.

4.2 The GBP price of all items displayed on our Site at the time the order is accepted will be honoured. If you are buying from outside the UK, you will also incur carriage costs and any duties levied by the jurisdiction to which you have specified delivery. The final price for overseas customers will be calculated in accordance with the applicable exchange rate on the day your card company processes the transaction.

4.3 Normally all items displayed on our site we offer are in stock and available for dispatch. Occasionally, if we are awaiting deliveries from suppliers you may be given the choice of making an advance payment. This will ensure that you receive the item in priority once we receive the stock. We shall only take advance payments for stock that has been scheduled for delivery. Your rights relating to advance purchases are the same as for any other purchase. You may also register your email address for notification of arrival of the selected merchandise not held in stock.

4.4 Items received into stock may be pre-allocated to satisfy advance payment orders and customers making advance payments will receive items in priority to customers on the waiting list or customers ordering through our Site for immediate delivery.

4.5 We may be unable to deliver selected advance payment merchandise due to production problems or quality check issues. In these circumstances we shall notify you by email and refund the advance payment to your card within 14 days of our being advised that merchandise has become unavailable.

4.6 If you have registered your email address for notification of the arrival of a specific product, we shall attempt to notify you within 48 hours of the product becoming available on our Site. Please note that certain products in particularly high demand may sell out during this period.

5. ACCEPTANCE OF YOUR ORDER

5.1 When you place your order, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order.

5.2 Unless we have notified you that we do not accept your order or you have cancelled your order, acceptance of your order and therefore completion of the contact between us will be perfected when we despatch the goods to you.

5.3 We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that there are delivery problems, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet our eligibility criteria.

5.4 We may in our sole discretion refuse to process a transaction for any reason or refuse service to anyone at any time. We shall not be liable to you or any third party by reason of our withdrawing any merchandise from our Site for any reason, removing or editing Site Content or refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

6. PAYMENT

6.1 Payment can be made by Visa, Visa Electron, MasterCard, Delta and Maestro cards. Payment will be debited and cleared from your account upon receipt of your order by E77. You confirm that the card being used is yours. All card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment to E77, we shall not be liable for any delay in delivery or non-delivery.

6.2 We take all reasonable care to make our Site as secure as we can. All card transactions on our Site are processed using a secure online payment gateway that encrypts your card details. You may store your card details on our systems. These details will be encrypted and only used to process card transactions.

6.3 So that your shopping experience is as safe, simple and secure as possible E77 uses Secure Socket Layer (SSL) technology. We take all reasonable care to keep the details of your order and payment secure but, in the absence of negligence on our part, cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data you provide.

7. INSURANCE

E77 insures each purchase until delivered to you. You will be asked to sign for goods delivered at which point responsibility for your purchase passes to you.

8. SITE CONTENT & DISCLAIMER

8.1 Site Content is everything appearing on our Site including all images, text, graphics, photographs, sounds, music or video.

8.2 We try to ensure that the information on our Site is accurate and complete but do not represent or guarantee that the Site Content is accurate, or free from error or that your use of the Site Content may not infringe third party rights. Use of our Site is entirely at your risk.

8.3 While we use all reasonable endeavours to ensure that our Site is safe we cannot guarantee that our Site or the server that makes it available is free from viruses or other harmful components.

8.4 If your use of our Site or Site Content results in the need for the servicing or replacement of any software equipment or data, we cannot accept responsibly for those costs. Our Site and Site Content is provided without any express or implied warranty.

8.5 E77 and its suppliers give no guarantee or warranty concerning Site Content, downloads, and links, or the success or results to be obtained from using our Site. E77 reserves the right in its absolute discretion and without notice to withdraw any Site Content at any time and without giving any reason.

9. CANCELLATIONS

9.1 The Consumer Protection Distance Selling Regulations entitle you to cancel your order within 7 days of receipt. If you decide to cancel written notice must be given to us not later than 7 working days after you have taken delivery of the goods.

9.2 Where a contract is cancelled, you must take reasonable care the goods. You have a duty to restore the goods to us or make them available to us for collection if we so require. Otherwise all items must be returned to us by post or pre-paid courier. All costs incurred by us in collecting the goods will deducted from the monies that we refund to you. If you arrange to return the goods to us it will be at your expense.

9.3 Subject to return or collection of the goods to us, we shall refund the price (less any deductions as above) to you not later than 28 days after we receive written notice of cancellation.

10. RETURNS & EXCHANGES

10.1 If you are not entirely satisfied with your purchase, you can return it to us within 14 days of receipt. You will be responsible for the cost of return. The goods must be in an unused condition and with all tags attached as sent to you. We shall offer a full refund on receipt. If preferred the purchase can also be exchanged for an item of a different colour or size. Some products may be non- returnable and these will be clearly marked on our Site.

10.2 If you receive a faulty or damaged item and wish to return it by post you should email us stating the order number and reasons for the return. Please also inform us whether you require an exchange or a refund. On receipt of your email we shall decide whether to ask you to return the item to us.

10.3 If you receive an incorrect item please email us stating the order number and informing us whether you require an exchange or a refund. On receipt of your email we will inform you what to do next.

10.4 The postage on goods returned to us will only be refunded to you in respect of an incorrect, damaged or faulty item. In any other case, you will be responsible for making sure that the purchase is returned to us safely and you will be responsible for the cost of doing so.

10.5 With all postal returns please ensure that the goods are securely wrapped, that our address is clearly marked on the package and that you obtain a certificate of posting from the Post Office; this service is free from the Post Office.

11. INTELLECTUAL PROPERTY RIGHTS

11.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property and material rights relating to the Site Content, including E77 Software and all HTML and other code contained in our Site, will remain at all times vested in E77 and/or are the property of E77’s licensors.

11.2 All Site Content, including third party trademarks, designs and related intellectual property rights mentioned or displayed on our Site is protected by national intellectual property and other laws. You are permitted to use the Site Content only as expressly authorised by E77 and/or its third party licensors. Any reproduction or redistribution of the Site Content is prohibited and may result in civil and criminal penalties. We shall pursue all remedies and sanctions available to us in respect of any breach of this term to the fullest extent permitted under the applicable law.

12. PERSONAL USE

Our Site is for your personal use and may not be used for any business or commercial use. You may not commercially exploit copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any Site Content, products, or services contained within our Site. You may not use our Site, or any Site Content, to further any business or commercial purpose or activity.

15.1 We use all reasonable endeavours to verify the accuracy of information on our Site but we give no warranties of any kind, express or implied, in relation to our Site, or any transaction that may be conducted on it.

15.2 We give no warranty that our Site will necessarily meet your requirements or will be uninterrupted, timely, secure or error-free, or that our Site or server that makes it available are free from viruses or bugs.

16. ENTIRE AGREEMENT

16.1 Our T&C constitute the entire agreement between you and E77 relating your use of our Site. No verbal information given to you by any party shall alter any term or the interpretation of the T&C. In agreeing to accept the T&C, you have not relied on any representation save insofar as expressly made in the T&C.

17. NO WAIVER

No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

18. GOVERNING LAW

The contractual arrangements between us including the T&C and all our policies and procedures will be governed by and construed in accordance with the laws of England and the parties you irrevocably submit to the exclusive jurisdiction of the courts of England.
